EMERGENCY CONDITIONS
If a dangerous situation occurs, immediately call the appropriate civil authority, such as the fire department, public utility department, police, etc.
If it is not a "Dangerous" situation, then determine if it is an "Emergency Condition" as defined:
At any time during the initial one year builder warranty period, should you experience an "Emergency Condition", please contact the appropriate contractor directly and THEN ALSO submit a formal request see step #2 on previous page.

Please refer to your closing papers to find the Plumber, Electrician and HVAC Company for your home. They are usually these:

Emergency Condition
"An "Emergency Condition" is one You, the Homeowner, cannot control that seriously affects your ability to live in the home or a condition that if not rectified will result in significant damage to the home. In case of an "Emergency Condition", You, the Homeowner, must notify the Builder immediately in order that further damages can be mitigated. If Your Builder has provided You with emergency numbers and/or procedures, You must comply with those procedures and/or exhaust those remedies. Failure to follow such procedures could result in your claim being denied and/or your warranty voided.
Typical Emergency Conditions:
There are three general areas emergencies will fall into:
-
Major electrical failure – does not include tripped circuit breakers or power outages caused by your electrical provider.
-
Heating/Cooling system
-
Major plumbing failure - does not include water leaks, which can be isolated by turning off the valve at the sink or commode and does not include sewage backup due to homeowner misuse. NOTE most homeowners insurance policies DO NOT cover sewage back up, so make sure you know where and how to operate the outside shut off valve.
You should take immediate action if circumstances dictate the need, but You agree that only those repairs necessary to eliminate the Emergency Condition or mitigate further damage shall be performed. You agree that any and all repairs performed beyond such measures will not be the responsibility of the Builder unless You first obtain the permission of Your Builder. Emergency Conditions occurring after normal business hours, over a weekend and/or on a holiday must be reported to the Builder on the next business day.
If after responding to your emergency request, it is determined that it was a false emergency (i.e., normal tripping of circuit breakers, replaceable blown fuse on the heating system, toilet overflow due to Homeowner misuse, etc.), any service call charges for the plumber, electrician or furnace technician, will be billed to the homeowner. Please be certain you have a legitimate emergency in order to avoid these charges.
ANY UNAUTHORIZED REPAIRS MADE BY YOU OR SOMEONE UNDER YOUR DIRECTION, OTHER THAN THOSE PERMITTED ABOVE, WILL NOT BE REIMBURSED OR COMPENSATE. THE DECISION AND DETERMINATION AS TO THE EXTENT OF EXPENSES THAT ARE REIMBURSABLE UNDER THE WARRANTY FOR EMERGENCY CONDITIONS IS THE SOLE DISCRETION OF THE BUILDER."
